By downloading, installing, or using the Charmys mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

2. Description of Service

Charmys is a mobile application designed to help users catalog and manage their Pandora charm collections. The App provides features including:

• Collection tracking and management
• Wishlist creation
• A marketplace for trading and selling charms with other users
• Messaging between users
• Charm catalog browsing

3. User Accounts

3.1 Account Creation

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Upload viruses or malicious code
• Attempt to gain unauthorized access to the App or its systems
• Use the App to spam or send unsolicited messages
• Scrape, data mine, or use automated tools to access the App
• Sell counterfeit or stolen items through the marketplace
• Circumvent any security features of the App

5. Marketplace Terms

5.1 User-to-User Transactions

The App provides a platform for users to list charms for trade or sale. Charmys is not a party to any transaction between users. We do not guarantee the quality, safety, or legality of items listed.

5.2 No Liability for Transactions

Charmys is not responsible for any disputes, damages, or losses arising from transactions between users. Users engage in transactions at their own risk.

5.3 Listing Guidelines

All listings must be accurate and not misleading. You must only list items you own and have the right to sell or trade. Counterfeit items are strictly prohibited.

6. Intellectual Property

6.1 App Content

The App and its original content, features, and functionality are owned by Alpay Kücük and are protected by international copyright, trademark, and other intellectual property laws.

6.2 User Content

You retain ownership of content you upload to the App. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the App.

6.3 Trademark Notice

Pandora is a registered trademark of Pandora A/S. Charmys is not affiliated with, endorsed by, or sponsored by Pandora A/S. All Pandora product names and images are the property of Pandora A/S.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Charm information, prices, and availability data are provided for informational purposes only and may not be accurate or up-to-date.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARMYS AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

9. Indemnification

You agree to indemnify and hold harmless Charmys and its developer from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
